The Coaching Relationship

 

Our relationship can be a powerful experience, involving the development of new possibilities, new levels of achievement and personal growth. This relationship is founded on mutual trust and respect. The central focus of the relationship is your well-being.

 

 

Fundamental to a successful experience is learning. I support you in reaching your desired outcomes. I will support you in exploring new ways to view situations, individuals, and possibilities and develop new approaches, plans, strategies, and actions. This innovation involves learning. You agree to be open to new concepts and ideas for learning to occur and remain teachable. At times the learning may be challenging and give rise to feeling such as frustration, stress and annoyance. There may be times when your learning involves discoveries about self and others, which may feel uncomfortable. I will support you by providing a judgement-free environment, guidance, encouragement, questioning and focus; however, it is your choice to use the resources and follow through on your commitment. This is up to you.

 

Our conversations are confidential. Information will not be shared without your written permission. The only exception is the duty of care and mandatory reporting should there be evidence of harm to yourself or others. This Agreement is entered into by and between Ocea Ebel, PO BOX 344, STEPNEY SA 5069 and You. In this Agreement, I will be referred to as the Coach, and you will be referred to as the 'Client', 'them' or 'their'. As a collective Coach and Client are referred to as 'the parties'.

 

Description of Coaching

Coaching is a partnership (defined as an alliance, not a legal business partnership) between the Coach and the Client in a thought-provoking and creative process that inspires the Client to maximise the personal, professional or business goals and to develop and carry out a strategy/plan for achieving those goals.

 

1)         Coach-Client Relationship

  1.  Coach agrees to maintain the ethics and standards of behaviour as outlined in the OM Code of Ethics
  2.   Client is solely responsible for creating and implementing their own physical, entail and emotional well-being, decisions, choices, actions and results arising out of or resulting from the coaching relationship and interactions with the Coach. As such, the Client agrees that the Coach is not and will not be liable or responsible for any actions or inaction or any direct or indirect result of any services provided by the Coach. The Client understands that coaching is not therapy and does not substitute therapy if needed, and does not prevent, cure, or treat any mental disorder or medical disease.
  3.  The Client acknowledges that they may terminate or discontinue the coaching relationship.
  4.  Client acknowledges that coaching is a comprehensive process that may involve different areas of their life, including but not limited to health, relationships, work, education, finances, and recreation. The Client agrees that deciding how to handle concerns and issues, incorporating and using coaching principles into those areas and implementing choices is exclusively the Client's responsibility.
  5.  Client acknowledges that coaching does not involve diagnosing or treating mental disorders as defined by The Royal Australian & New Zealand College of Psychiatrists. That coaching cannot substitute for counselling, psychotherapy, psychoanalysis, mental health care, substance abuse treatment, or other professional advice by legal, medical or other qualified professionals. It is the Client's exclusive responsibility to seek such independent professional guidance as needed. Suppose the Client is currently under the care of a mental health professional. In that case, it is recommended that the Client promptly inform the mental health care provider of the nature and extent of the coaching relationship agreed upon by the Client and the Coach.
  6.  Client understands that to enhance the coaching relationship, the Client agrees to communicate honestly, be open to feedback and assistance, and create the time and energy to participate fully in the program.

 

2)         Services, Schedule and Fees

The parties agree to engage in the coaching program as outlined upon purchase. The detailed inclusions are as follows.

  3.  3 x 50 minute 1:1 sessions via Zoom

III.        Journal

  1.  3 x tailored support resources
  2.  14-day meal plan with recipes & shopping list
  3.  1 x 15-minute check-in call between sessions at a mutually convenient time

VII.       1 x email check-in at the conclusion of sessions

VIII.      Program is valid for 90 days from the date of purchase

3)         Procedure

The coaching meetings/sessions will be determined by the Coach and Client based upon a mutually agreed upon time. Meetings/sessions will be delivered through Zoom unless otherwise indicated. The Client will initiate all scheduled meetings/sessions through the Zoom meeting links created by the Coach.

 

4)         Confidentiality

This coaching relationship and all information (documented or verbal) that the Client shares with the Coach as part of this relationship are bound by the principles of confidentiality as outlined in the OM Code of Ethics. However, the Coach-Client relationship is not considered a legally confidential relationship (like the medical and legal professions). Thus, communications are not subject to the protection of any legally recognised privilege. The Coach agrees not to disclose any information pertaining to the Client without the Client's written consent. The Coach will not disclose the Client's name as a reference without the Client's consent. Confidential information does not include information that: (a) was in the Coach's possession prior to its being furnished by the Client; (b) is generally known to the public or in the Client's industry; (c) is obtained by the Coach from a third party, without breach of any obligation to the Client; (d) is independently developed by the Coach without the use of or reference the Client's confidential information; or (e) the Coach is required by statute, lawfully issued subpoena, or by court order to disclose; (f) is disclosed to the Coach, and as a result of such disclosure the Coach reasonably believes there to be an imminent or likely risk of danger or harm to the Client or others; (g) involves illegal activity. The Client also acknowledges their continuing obligation to raise any confidentiality questions or concerns with the Coach in a timely manner.

 

5)         Release of information

The Coach engages in training and continuing education; this process may require Clients' names and contact information for possible verification. No personal notes will be shared.

 

6)         Cancellation Policy

The Client agrees that it is the Client's responsibility to notify the Coach at least 24 hours before the scheduled meeting/session. The Coach reserves the right to charge the Client for a missed meeting. The Coach will attempt in good faith to reschedule the missed meeting/session.

 

7)         Record Retention

Records will be kept in electronic form for not less than two years once the Coach-Client relationship has ended. These include documents, information, and data acquired or shared during the term of the Coach-Client relationship. Request for records can be made in writing to the Coach.

 

8)         Termination

Either Client or Coach may terminate this Agreement at any time with 14 days' written notice. The Client agrees to compensate the Coach for all coaching services rendered (including missed meetings/sessions) through and including the effective date of termination of the coaching relationship.

 

9)         Limited Liability

Except as expressly provided within this Agreement, the Coach makes no guarantees, representations or warranties of any kind or nature, express or implied with respect to the coaching services negotiated, agreed upon and rendered. The Client will not hold Coach liable for any loss or cost incurred in the event of mental, physical, emotional stress or distress caused directly or indirectly concerning meetings/sessions. The Client will indemnify Coach in the event of any such claim. In no event shall the Coach be liable to the Client for any indirect, consequential or special damages. Notwithstanding any damages that the Client may incur, the Coach's entries liability under this Agreement, and the Client's exclusive remedy, shall be limited to the amount actually paid by the Client to the Coach under this Agreement for all coaching services rendered through and including the termination date.

 

10)       Entire Agreement

This document reflects the entire Agreement between the Coach and the Client and reflects a complete understanding of the parties with respect to the subject matter. This Agreement supersedes all prior written and oral representations. The Agreement may not be amended, altered or supplemented except in writing signed by both the Coach and the Client.

 

11)       Dispute Resolution, Applicable Law

If a dispute arises out of this Agreement that cannot be resolved by mutual consent, the Client and the Coach agree to attempt to mediate in good faith for up to 30 days after notice is given. If a resolution is not obtained, the legal process will follow the governing law and jurisdiction as outlined on https://www.oceamarie.com/terms-of-use. Become valid and enforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.

 

12)       Severability

If any provision of this Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If the Court finds that any provision of this Agreement is invalid or unenforceable, but that by limiting such provision, it would

 

13)       Waiver

The failure of either party to enforce any provision of this Agreement shall not be construed as a waiver or limitation of that party's right to subsequently enforce and compel strict compliance with every provision of this Agreement.

 

14)       Binding effect

This Agreement shall be binding upon the parties hereto and their respective successors and permitted assigns.
